Welcome to Four/Point/Eight. Four/Point/Eight and all affiliated websites are owned and operated by The Clever Ideas Lab, LLC and based in Atlanta, Georgia in the United States. The Four/Point/Eight Platform is a media platform dedicated to emerging and indie brands in home interiors, home entertaining, fashion, skincare, fragrance and design. Four/Point/Eight brings together retailers, products, manufacturers, brands and design enthusiasts to explore, discover, be entertained and enjoy.

Four/Point/Eight is committed to protecting your privacy. This Privacy Policy is to help you understand what information Four/Point/Eight collects, why we collect it, how Four/Point/Eight uses it, how it may be shared, and what choices you have. This privacy policy governs the products, content and services we offer through our website, mobile applications and other applications (collectively the “Site” or “Four/Point/Eight Platform”). When you use the Site, you consent to our collection, use and disclosure of information about you as described in this privacy policy. Additionally, our Terms of Use are incorporated by reference into this privacy policy, including applicable terms governing limitations on liability and the resolution of disputes. The terms “we,” or “our,” refer to The Clever Ideas Lab LLC, a Georgia limited liability company, which are headquartered in Atlanta, Georgia in the United States and are the sole owner of Four/Point/Eight and all affiliated websites, including Berchard’s Fine Living, Asbury Apothecary and FOUR/POINT/EIGHT.

1. COLLECTION OF INFORMATION

We collect information (i) from you directly; (ii) from third parties, and (iii) automatically when you use our Site. In general, we collect information as follows:

  • Personal Information.  When you create an account on the Four/Point/Eight Platform, we collect your name, contact information, and other information you provide. You also will be asked to create a profile on the Site. If you do, profile information such as your name, username, current projects, demographic information, and any photo you submit may be displayed publicly on the social network. You can customize some of the information displayed publicly in your Four/Point/Eight profile by going to your account and profile settings. If you feel that an unauthorized account has been created depicting you or your likeness, please contact us at privacy@Four/Point/Eight.com. You have an obligation to provide us accurate information.
  • Types of Personal Information Provided. Depending on what you provide, this information can include your name, address or location, phone number and email address, date of birth, gender, purchase information, shopping preferences, images and financial information (including your credit or debit card details, although we do not hold them, our payment processors do).
  • Inviting Friends. If you register an account on the Website, then you may choose to give us your photograph and nickname. From your account, you can also invite your friends to shop at our Website (including by email, Facebook, Instagram or Twitter). Although we will let them know that we received their details from you, please ensure that you have the permission of your friends before sharing their contact details with us and only forward emails to people you know would be happy to receive them.

    This type of information is individually identifiable information (“Personal Information”). This information may identify an individual or may be of a private and/or sensitive nature. Personal information which is being gathered consists of any personal details provided consciously and voluntarily by you including name, email, address, IP address and other unique identifiers and any other information you choose to provide to Four/Point/Eight.

  • Information We Collect from Other Sources. Four/Point/Eight can receive information about you from other sources, such as from your other accounts or other websites, including data brokers, our partner boutiques, social media providers like Facebook and Twitter, advertising networks and analytics partners, and payment and delivery service providers. 
  • Linked Accounts. By logging in to our mobile applications via Facebook or Twitter or linking your account on our Website to your Facebook or Twitter accounts, you are giving Four/Point/Eight permission to obtain certain information and content from these accounts. The specific types of information that we may obtain depends on your settings for that account or website and will be subject to their privacy policies.
  • Supplemental Data Collection. Four/Point/Eight supplements the data you provide to us with data from data append services such as public or social graph data in order to better serve you with content or promotions. We will append this data to our existing customer account information to better understand customers’ interests and to provide more relevant product recommendations and advertising, to increase our customer’s security when using our Website and to comply with our legal obligations, such as sanctions laws. This information may include household size, household income, or profession. This information can be associated with your personal information such as name, email, address, physical address or phone number. 
  • Anonymous Data Collection. each time you visit the Website, certain information will be created and automatically recorded by our IT systems. That information includes:
    • Cookies: Cookies are small text files can help improve your experience with the Website and make it easier to interact with us. This may include storing your location or language preferences to save you having to re-enter information when returning to, or ensuring that items you wish to order don’t disappear as you navigate between pages on, our Website. We also use cookies to provide you with tailored advertising;
    • Device Information: the information provided by your device will differ depending on which type of device you are using (whether it’s a PC, Mac, iPhone, Android, or otherwise) and the settings on that device, but includes the type of device you have (such as an iPhone 6S or Samsung Galaxy S7), the device’s IP address, the browser you are using, your mobile network provider (for mobile devices), the pages you have visited, your time zone and country location, and crash or download error reports.

This type of information is non-identifiable and anonymous information (“Non-personal information”). We are not aware of the identity of the User from which we have collected Non-Personal Information. Non-Personal Information is any unconcealed information which is available to us while Users are using the Four/Point/Eight Platform. Non-personal Information which is being gathered consists of technical information and behavioral information, including, but not limited to, your use of the Site (including our mobile applications), such as your search activity, the pages you view, and the date and time of your visit. We also collect and may store information that your computer or mobile device provides to us in connection with your use of the Site, such as your browser type, type of computer or mobile device, browser language, IP address, mobile carrier, unique device identifier, location, and requested and referring URLs.

  • Legal Obligation. As customers, you do not have any legal obligation to provide any information to Four/Point/Eight. However, we require certain information from you in order to operate properly, including completing a transaction on your behalf. Login credentials (email and username) enable us to personalize and improve our services. You hereby agree and acknowledge that any Personal Information you do provide to us is provided at your own free will, for the purposes mentioned in this Privacy Notice and that we may keep such Personal Information in a database(s) which will be registered and kept in accordance with applicable laws and regulations
  • Data Storage. We retain personal information no longer than is legally permissible and delete personal information when it is no longer necessary for the purposes set out in this Notice.

2. USE OF INFORMATION

Data Usage.We may use the information we collect for purposes such as to: provide the Site’s functionality; improve the Site’s quality; personalize your experience; tailor the content and information that we may send or display to you; offer location customization, and otherwise offer personalized help and suggestions; track usage of the Site; facilitate the fulfillment of your orders placed through the Site; provide feedback to businesses and professionals whose products or services are listed on the Site; display relevant advertising (on our Site and third party sites); evaluate the success of our advertising; provide customer support; communicate with you about your use of the Site and any orders; allow third parties to contact you through the Site; respond to your inquiries and requests; send you marketing communications and otherwise message you (in ways described by this privacy policy and managed by you in your account settings); back up our systems and allow for disaster recovery; enhance the security of the Site; fulfill transactions authorized by you on the Site; use as otherwise requested or consented to by you; and to comply with legal obligations.

Data Collection for Marketing Purposes. We also use the information for marketing and advertising purposes. Where you have told us that you would like to receive marketing communications or when you have made a purchase using our services, we and our partner boutiques will use your personal information (including your name, email address and address) to occasionally send you updates, news, and offers via email, posts or other forms of media. We may use your information (including supplemental information received from partners that we append to our existing customer information as described below), to tailor these messages to you. You may unsubscribe from email marketing communications by modifying your preferences in your account’s profile management section, or by following the opt out instructions in the promotional emails we send you.

We use third-party service providers to serve advertisements most relevant to you across your different devices and on our own and others’ websites and mobile applications. In addition to the information about your visits to our website or usage of our mobile application, our service providers may also use the information about your interactions with other websites or applications to target advertisements for products available from Four/Point/Eight. Data Collection for Statistical Purposes. We also carry out research, analysis, and surveys on your use of our Website, and views. We keep tracking of your purchase history on our Website to see if you can benefit from our exclusive loyalty programs. And finally, we use your information to confirm your identity and perform credit checks or anti-fraud checks, in order to ensure your, and our, financial security. 

Selling of Data. Please note that we do not sell your information without your consent (whether your name, address, emails address, financial information, or otherwise) to any third party.

  • To register and manage your account in our Website, we collect your name, email, password and other additional details you may wish to add in your account, like phone number, addresses and gender. The legal basis is the performance of a Contract with you.
  • To fulfil the purchases you make through our website, we collect your Name, addresses, phone number, Order details, like the products you are buying, the size and price. The legal basis is the performance of a Contract with you.
  • To collect payment from you we collect your payment information, which comprises the credit/debit card’s number, holder’s name and CCV – we do not store them and only transfer them to our authorized payment providers. The legal basis is the performance of a Contract with you.
  • To provide you with our customer services (including helping you to solve any issue you have with our services, updating you about any change to our terms of service, or contacting you to know how your experience was with us, we collect your name, email, password and addresses and your contact history with us (including phone records of our conversations. The legal basis is the performance of a Contract with you and our legitimate interests in retaining you as a customer
  • To monitor the quality of our customer services, we collect your name, email, password and addresses and your contact history with us. The legal basis is the legitimate interests in running our business.
  • To administer, maintain and optimize our Website and our services, we collect your device information (such as your device IP address and device type), Cookie identifiers and browsing information. The legal basis is the legitimate interests in running our business.
  • To perform fraud and credit checks and if we can do business with you, we collect your name; email; addresses; credit/debit card details; browsing history; purchase history; date of birth; gender; device information (such as IP address and device type), any national identifiers (like driver’s license or ID cards) and any publicly available information (like social media profiles or news). The legal basis is the legitimate interests to protect Four/Point/Eight and its customers from fraudulent activities and compliance with a legal obligation.
  • To send you marketing communications and personalized offers, we collect your Name; Email; Phone Number; Addresses; Date of Birth; Purchase history; Browsing history and behavior; Device information; Shopping preferences; Cookie identifiers; Internal identifiers; Country. The legal basis is the legitimate interests to electronic direct marketing of similar products and services to that which you have acquired using our Website or, when such is not applicable, your Consent.
  • To manage our loyalty programs, we collect your Name; Email; Phone Number; Addresses; Date of Birth; Purchase history; Browsing history and behavior; Device Information; Shopping preferences; Nickname; Cookie identifiers; Internal identifiers; Country; Spent tier level and Wealth. The legal basis is our legitimate interests in running our business and improve the shopping experience.
  • Analysis of your behavior and purchases in our Website, we collect your Name Email; Phone Number; Addresses; Date of Birth; Purchase history; Browsing history and behavior; Device Information; Shopping preferences; Nickname; Cookie identifiers; Internal identifiers; Country; Spent tier level and Wealth. The legal basis is our legitimate interests in running our business and improve our Website and your experience.
  • Carry on research, analysis, enquiries and surveys on your use of our website, we collect your Name; Addresses; Email; Device information, demographic information (including gender, country of residence and household income) and content of survey responses. The legal basis is our legitimate interests in running our business and improve our Website and your experience.
  • Advertising and retarget advertising, we collect your email, cookie identifiers and device information. The legal basis is our legitimate interests in running our business.

3. STORAGE OF YOUR INFORMATION

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It may also be processed and used by staff operating outside the EEA who work for us or by one of our suppliers. Such staff may be engaged in, among other things, the fulfilment of your request, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Notice.

Data Storage.All information you provide to us is hosted and stored on Amazon Web Services cloud-based services in Ireland which is also in compliant with ISO27001 standard. For further information on the measures taken by Amazon to protect the security of their servers and your personal data, please see: http://aws.amazon.com/security/. If you are not satisfied with the levels of security offered by our cloud provider, you should restrict the nature and amount of personal data or confidential information which you include in your log data or not use the Services. Any payment transactions will be encrypted using Secure Socket Layer (SSL) technology. Where we have given you (or where you have chosen) a password which enables you to access certain parts of the Four/Point/Eight Platform, you are responsible for keeping this password confidential. You must not share a password with anyone.

4. SHARING YOUR INFORMATION

To provide the Website and our services, we work with a number of carefully selected third parties. To do this, we may share your information with these third parties in the following limited circumstances. We share your Personal Information only as described in this Notice and require commercial entities with which we share your Personal Information to agree to keep your information confidential.

  • Four/Point/Eight Partner Websites.Four/Point/Eight works with a variety of merchants (“Four/Point/Eight Partners”) in order to offer you the widest possible choice of design items through the Four/Point/Eight Platform. We promote and sell the items offered by the Four/Point/Eight Partners through the Four/Point/Eight Platform. When you choose to buy an item, you may be taken directly to their online store. You can easily recognize when a third-party business is associated with your transaction, and we will share your personal data that is related to such transactions with that business. Please note that: (i) the third-party business will use and share your personal data in accordance with its privacy policy; (ii) you should check its policy before completing any transaction involving such third-party business; and (iii) such third-party business is solely responsible for its use and sharing of your personal data.
  • Third party service providers for business purposes.In order to function properly, we rely on a number of carefully selected third parties to provide us with services and products. We permit these companies to use your personal information only to the extent necessary to provide us with their services and products. Below you can find the types of third parties we use: 
  • Courier companies, such as DHL and UPS, that we use in order to deliver the products to you and, as such, they need to have access to your order information, including your name and address. These providers have a global outreach, with many local companies that can be engaged depending on your shipping address;
  • Payment providers that we use to process your payment information (including your credit/debit card details) so that we can collect payment from you. These are based in the European Union, United States and China and are engaged depending on your location; 
  • Anti-fraud and credit check providers to keep us and you secure. They have access to and process your information and associated orders in order to check for any fraudulent behavior. Our current provider is based in Israel.
  • Analytics and search engine providers, like Google, that we use to assist us in the improvement and optimization of the website. These providers are based in the United States and in Europe.
  • Marketing Tools providers that help us to enable our marketing, such like Oracle Responsys and Mention Me. These providers are based in the United States.
  • Performance Marketing Providers that help us deliver advertising of Four/Point/Eight tailored to your interests and needs. These providers are based in Europe (mostly in the UK) and in the United States
  • Research companies that we can engage to help us carry out surveys regarding your use of our Website and Services. These providers are mostly based in the United States, the UK and Europe. 
  • IT/technology providers that we use to support, maintain and provide our technology and IT infrastructure that supports our Website and the storage of your information. This includes Amazon AWS that we use to host your information and that it is based in the United States. 
  • Business Transfers:If we are acquired by or merged with another entity, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected about you to the other company. We may also disclose certain personal information to a company as part of the planning or review for a potential merger, acquisition or transfer of assets.
  • Third party service providers to enrich data.Four/Point/Eight may also enrich, match or combine information we hold about you with data from other sources, for instance by sharing some of your personal data with selected business partners. These partners are based in the United States, the UK, Europe and Asia. We do this to better understand your customer profile and interests so that we can deliver customized offers and other personalized services.
  • Advertisers for marketing purposes.Four/Point/Eight can provide your information to our advertising and social media partners (including Facebook, Instagram and Twitter, where you choose) where they require the data to select and serve relevant advertisements about our products and services to you and others.
  • To comply with legal requests.On occasion, we may be required to liaise with various regulators and law enforcement agencies in a number of different countries, whether as a result of law, a court order, or another legal process. Although we dispute requests wherever suitable, in some cases we may have to share your information with the regulators or law enforcement agencies. Where we consider it appropriate, and provided we are not prohibited from doing so by law or court order, we will attempt to notify you of these legal demands; and
  • Aggregated information with third parties.We may aggregate your information with the information of other customers, creating a dataset of information about the usage of our Website, purchase of products, and other general, grouped information about our customers on the basis of our legitimate interest to understand the usage of our service and demand for our product. Although this dataset is aggregated and anonymized, meaning it cannot identify you as an individual, it provides a valuable insight into the use of our Website and we may therefore share it with select third parties. These parties may include providers of plugins or similar technologies to help measure traffic, our partner boutiques and other providers to allow them to better stock products, and our investors. Please note that we do not share your information with any third-party advertisers or networks for the provision of third party advertising on our Website.

5. DATA TRANSFER

To provide our Website and our services, in accordance with the purposes set out above, we may transfer and store the personal information that we collect from you to a destination outside of the European Economic Area (“EEA”), mostly to the United States, either to one of our Group Companies, to one of our partner boutiques or to one of the third parties with which we work, as stated below:

Data Transfer Security.When transferring personal information to one of our Partner Companies outside the EEA, which may be the USA, India, Russia, Japan or China, we rely on the Commission’s model contracts for the transfer of personal data to third countries (i.e. the standard contractual clauses) pursuant to Decision 2010/87/EU; We transfer the personal information to one of our partner boutiques outside the EEA, to the extent such transfer is needed to fulfil the contract between you and the boutique which you are ordering the products from. When transferring personal information to one of our third-party services’ providers set out above, we rely on different adequacy measures, as set out below:

  • Privacy Shield: Some of our third-party providers based in the US, where we transfer your information to, comply with the US Department of Commerce's EU-US Privacy Shield and have certified that adhere to the EU-US Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability. For more information about the EU-US Privacy Shield Framework, visit the U.S. Department of Commerce's Privacy Shield website.
  • Model Clauses: We rely in the Commission’s model contracts for the transfer of personal data to third countries (i.e. the standard contractual clauses) pursuant to Decision 2010/87/EU when transferring your information to our US service providers who do not adhere to the US Department of Commerce's EU-US Privacy Shield.

6. DATA SECURITY

The personal data in the Four/Point/Eight account you have with us is protected by a password for your privacy and security. You need to ensure that there is no unauthorized access to your account and personal data by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. Four/Point/Eight encourages you to use “strong” passwords (passwords that use a combination of upper and lowercase letters, numbers and symbols) with your account. Four/Point/Eight cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

Keeping Your Data Secure.Keeping you and your personal information secure is very important to us. We take a number of reasonable steps to try to protect the personal information that you provide, including:

  • Using a Secure Socket Layer (“SSL”) to encrypt the personal data that you send us during the order process (including any financial information such as credit or debit card details).
  • Requiring you to establish a password to access your account on our Website.
  • Not keeping details of your credit or debit card that would enable any third party to transact using that credit or debit card (such as your CCV number); and
  • Regularly monitoring our servers and IT systems for possible vulnerabilities and attacks.
    • Guarantee. Unfortunately, the transmission of information via the Internet is not completely secure. Four/Point/Eight endeavors to protect personal data but Four/Point/Eight cannot guarantee the security of your data transmitted to our Services. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our platform; any transmission of data is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access. In particular, please keep in mind that if you voluntarily disclose personal information through other means of communication than the Website in a non-protected environment (such as through email, SMS, online messages) then that information can be collected and used by others outside of our or your control.

7. LINKS TO THIRD-PARTY WEBSITES

Four/Point/Eight contains links to other third-party sites. Four/Point/Eight is not responsible for the privacy policies and/or practices on other sites. When linking to another site you should read the privacy policy stated on that site. This Notice only governs information collected on the Services.

Four/Point/Eight will take care to maintain appropriate safeguards to ensure the security, integrity and privacy of the information you have provided us with. We encrypt your information to protect it from unauthorized use. In addition, we will take reasonable steps to ensure that third party business partners to whom we transfer any data will provide sufficient protection of that personal data.

To help ensure that your shopping experience is safe, simple, and secure, we use Secure Socket Layer (SSL) technology.

8. ACCESSING YOUR PERSONAL DATA

Four/Point/Eight allows you to access the following information about you for the purpose of viewing, and in certain situations, updating that information: your name; user email address; username and password; profile picture; bio; website; user preferences; zip- and/or post-codes, billing address, and payment information.

The information you can access will change as the Services change. If you are a registered user of Four/Point/Eight, you can change or delete any saved payment card details and add or edit shipping and billing address information.

In the EU, the General Data Protection Regulation (the "GDPR") gives you the right to access information held about you. For any request or question regarding obtaining a copy of personal data we hold relating to you, and/or correction or deletion of your personal data, and/or object to any processing of your personal data, you can submit a Subject Access Request by contacting us at privacy@hntrism.com/ We will respond to your access and/or correction request within 30 days.

However, please note that although your Personal Information may be removed from our databases, Four/Point/Eight will retain the anonymous information contained in the data you provided, and such information will continue to be used by us for statistical purpose.

As set out above, you can always opt not to disclose information, even though it may be needed to take advantage of the Services.

You are able to add or update certain information on pages, such as those listed above. When you update information, however, we often maintain a copy of the unrevised information in our records.

Once Four/Point/Eight accounts are activated, you may request deletion of your account by following the instructions at the Account Settings section of the Four/Point/Eight Platform. Please note that some information may remain in our records after deletion of your account.

9. Four/Point/Eight COMMUNICATIONS

Controlling Four/Point/Eight Communications.When you join the Four/Point/Eight Platform by signing up for an account or creating a profile, as part of the service you will receive the Four/Point/Eight newsletter about the offerings and features on the Site. As permitted by law, you are also opting to receive other emails from us that may be of interest to you as a member of the Four/Point/Eight community. You can manage your email and notice preferences in account settings, but note that you cannot opt out of receiving certain administrative or legal notices from us. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you transactional e-mails about your account or any services you have requested or received from us. However, you may opt out entirely of receiving any text messages – promotional, transactional or otherwise – from us. You can however change the type and frequency of the emails you receive from us at any time by changing your email settings here or by unsubscribing from such emails.

Disabling Location Services.Most mobile devices provide users with the ability to disable location services. These controls are usually located in the device's settings menu. Please contact your mobile service carrier or device manufacturer if you have questions about how to disable your device's location services.

Please note that if you choose not to receive legal notices from us, such as this Notice, those legal notices will still govern your use of the Services, and you are responsible for reviewing such legal notices for changes.

Protecting Yourself.Additionally, by joining, you are agreeing to receive feedback and communications from third-parties within the Site, including third-party providers of products or services who may comment on your postings within the Site. If you don’t want third parties to see such information, you should not post it to your profile or the Site.

10. COOKIES AND OTHER TRACKING TECHNOLOGIES

Four/Point/Eight and the third-parties we interact with, including our third-party service providers, use cookies in connection with your use of the Site and third-party websites (Cookies are small data files that may have unique identifiers, and reside, among other places, on your computer or mobile device, in emails we send to you, and on our Site. We also use web beacons for similar purposes on our Site, and in HTML e-mails to our customers (e.g., to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded). In addition, we may use local shared objects (sometimes called "flash cookies"), java script, log files, and similar technologies (together with cookies and web beacons, collectively referred to as “Cookies” in this policy) to track and analyze site usage and facilitate advertising on our Site and third-party sites.

We may use Cookies to collect or transmit information about you and your use of the Site or third-party sites, such as: your browser type, search preferences, data relating to advertisements that have been displayed to you or that you have clicked on, your interests on our Site and other sites, and the date and time of your use. When we use Cookies, we do so in order to further Site features and processes, provide authentication and security for your transactions on the Site, store your preferences, facilitate relevant advertising, and help us learn more about how users engage with the Site, and understand your activities after you leave our Site. Our Cookies may be persistent or stored only during an individual session.

You may opt-out of tracking by third parties for certain advertising purposes (as discussed) which can help you control targeted advertising by third-parties that track your activities across sites. Third-Party Analytics.We also use automated devices and applications, such as Google Analytics, to evaluate usage of our Sites and the services we provide; you can opt out of Google Analytics and review its privacy policy here. We use these tools to gather non-personal information about users to help us improve our services, performance and user experiences. These analytics providers may use Cookies to perform their services and may combine the information that they collect about you on our Site with other information that they have collected. This policy does not cover such third-parties’ use of the data.

11. THIRD-PARTY ADVERTISING

As noted, we work with third parties such as network advertisers to serve advertisements on third-party websites or other media, and to evaluate the success of our advertising campaigns, including Facebook, Google, and others (both Facebook and Google offer additional ways to opt out of certain advertising activities, and maintain their own privacy policies that address their interest-based advertising services). We also may work with third parties to display ads on our Site.

Third-party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. This enables us and these third parties to target advertisements to you for products and services in which you might be interested, based upon your activities on our Site and other websites. These third-party cookies and other technologies are governed by each third party’s specific privacy policy, not this one. We may provide these third-party advertisers with information about members or allow them to collect certain information through our Site (e.g., IP address and demographic information), but we do not disclose your name, contact information or other personally identifiable information.

You can also manage many opt-out of receiving behaviorally-targeted ads from many companies via the consumer choice tools created under self-regulation programs in many countries, such as the US-based aboutads.info choices page or the EU-based

Opting out from one or more companies listed on the respective opt out pages noted above, will opt you out from those companies’ delivery of interest-based content or ads to you based upon your activities on multiple websites, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies, or you subsequently delete your cookies, your opt out may not be effective. Additional information is available on the websites listed above.

12. PLUG-INS AND SOCIAL MEDIA WIDGETS

Four/Point/Eight may include social media features and widgets, such as the Facebook Like button and the "Share this" button, as well as other interactive mini-programs that run both on our Site and Services and on third-party websites, and enable certain features to work (e.g., blogs and comments). These features may collect your IP address, which page you are visiting, and may set a cookie to enable the feature to function properly and for other purposes. When these features are displayed on our Site they are hosted by third parties, and are subject to their own privacy policies, not this one. Your interactions with these features are governed by the privacy policy of the company providing them.

13. CHOICE AND ACCESS TO YOUR PERSONAL INFORMATION

You have certain choices about how to control your data, including publicly displayed profile information, communications settings, network linking, and opting out of tracking by third- parties for certain advertising purposes. These choices are described throughout this privacy policy in the relevant sections. Further, you may modify any account information that you have submitted by logging into your account and updating your profile information. Please note that copies of information that you have updated, modified or deleted may continue to reside in our systems for a period of time, and we may maintain copies as part of our business records.

We retain the data you provide to us for as long as you have your account with us and thereafter for such period as you may have questions or a claim in relation to our services, notwithstanding any superior retention period that we may be obliged to observe in accordance with legal requirements applicable to us.

In some circumstances you can ask us to delete your data as set out below.

After you have terminated your use of our services, we may store your information in an aggregated and anonymized format.

14. ACCOUNT TERMINATION AND DATA RETENTION

You can close your account at any time by going to account settings. When you close your account, you will cease to provide ongoing or future data to us. Your public profile will be deactivated. However, unless prohibited by applicable law, postings or comments you provided to the Site prior to closing your account, will remain public. We also may retain information about you for the purposes authorized under this privacy policy, including a copy of your account information as part of our business records, unless prohibited by law.

After a request from a User to delete any data, an automated process will begin that permanently deletes the relevant data. Once begun, this process cannot be reversed and data will be permanently deleted. Any data which is not deleted shall be kept in an anonymized manner.

As a registered User you can always view, access, change and delete your information by logging into your account.

Similarly, Four/Point/Eight collects and retains usage data, other metadata and statistical information concerning the use of the Service are not subject to the deletion procedures in this Notice and may be retained by Four/Point/Eight. Some data may be retained also on our third-party service providers’ servers.

15. CHILDREN

The Site is intended for general audiences and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal information without parental consent, please contact us at privacy@hntrism.com, and we will take steps to remove such information and terminate the child's account.

16. PRIVACY RIGHTS

You have certain rights in relation to the personal data we hold about you, which we detail below. Some of these only apply in certain circumstances as set out in more detail below. We also set out how to exercise those rights. Please note that we will require you to verify your identity before responding to any requests to exercise your rights and that can include asking a set of security questions to ensure it is you. When you have appointed someone else to do the request on your behalf, that person and/or organization needs to show a valid power of attorney issued by you. We must respond to a request by you to exercise those rights without undue delay and at least within one month (although this may be extended by a further two months in certain circumstances). Access.You have the right to know whether we process personal data about you, and if we do, to access data we hold about you and certain information about how we use it and who we share it with (including the categories of personal data we share with businesses for their direct marketing uses and the names and addresses of those businesses). Please note that in “My Account” dashboards, you can see information about you, namely your account details (such as name, email, phone number, date of birth), the addresses you use for billing and shipping, your order history and shopping preferences. 

Requesting Your Information.You can also request a copy of your information. If you require more than one copy of the data we hold about you, we may charge a reasonable administration fee. We may not provide you with certain personal data if providing it would interfere with another’s rights (e.g. where providing the personal data we hold about you would reveal information about another person) or where another exemption applies.

Portability.  You have the right to receive a subset of the personal data we collect from you in a structured, commonly used and machine-readable format and a right to request that we transfer such personal data to another party. The relevant subset of personal data is data that you provide us with your consent or for the purposes of performing our contract with you. 

If you wish for us to transfer the personal data to another party, please ensure you detail that party and note that we can only do so where it is technically feasible. We are not responsible for the security of the personal data or its processing once received by the third party. We also may not provide you with certain data if providing it would interfere with another’s rights (e.g. where providing the personal data we hold about you would reveal information about another person or our trade secrets or intellectual property).

Correction.You have the right to correct any personal data held about you that is inaccurate. You can edit your personal information in “My Account” settings. You can also request the correction by emailing us. Please note that in some cases we can ask you to explain in detail why you believe the personal data we hold about you to be inaccurate or incomplete so that we can assess whether a correction is required. Please note that whilst we assess whether the personal data we hold about you is inaccurate or incomplete, you may exercise your right to restrict our processing of the applicable data as described below.

Erasure. You may request that we erase the personal data we hold about you in the certain circumstances. Please scroll below to know what those are:

  • you believe that it is no longer necessary for us to hold the personal data we hold about you;
  • we are processing the personal data we hold about you on the basis of your consent, and you wish to withdraw your consent and there is no other ground under which we can process the personal data;
  • we are processing the personal data we hold about you on the basis of our legitimate interest and you object to such processing. Please provide us with detail as to your reasoning so that we can assess whether there is an overriding interest for us to retain such personal data; 
  • you no longer wish us to use the personal data we hold about you in order to send you promotions and special offers;
  • you believe the personal data we hold about you is being unlawfully processed by us.

Also note that you may exercise your right to restrict our processing the data whilst we consider your request as described below. 

Please provide as much detail as possible on your reasons for the request to assist us in determining whether you have a valid basis for erasure. Please note, however, that we may retain the personal data if there are valid grounds under law for us to do so (e.g., for the defense of legal claims or freedom of expression) but we will let you know if that is the case. 

Where you have requested that we erase data that we have made public and there are grounds for erasure, we will use reasonable steps try to tell others that are displaying the data or providing links to the data to erase the data too.

Restriction of Processing to Storage Only.You have a right to require us to stop processing the personal data we hold about you other than for storage purposes in certain circumstances. Please note, however, that if we stop processing the personal data, we may use it again if there are valid grounds under data protection law for us to do so (e.g. for the defense of legal claims or for another’s protection).

  • you believe the personal data is not accurate for the period it takes for us to verify your claim;
  • we wish to erase the personal data as the processing we are doing is unlawful, but you want us to retain the personal data for storage but not further process it;
  • we wish to erase the personal data as it is no longer necessary for our purposes, but you require it to be stored for the establishment, exercise or defense of legal claims; or
  • you have objected to us processing personal data we hold about you on the basis of our legitimate interest and you wish us to stop processing the personal data whilst we determine whether there is an overriding interest in us retaining such personal data.

Objection.At any time you have the right to object to our processing of data about you in order to send you promotions and special offers, including where we build profiles for such purposes and we will stop processing the data for that purpose. You can do so by changing your marketing preferences at “My Account” or by ticking “unsubscribe” at the bottom of each marketing email we send you. Please note that you will still receive emails related with the orders you make through our Website or updates to our Terms & Conditions and Privacy Policy.

You also have the right to object to our processing of data about you and we will consider your request in other circumstances as detailed below: 

  • we are processing the data we hold about you (including where the processing is profiling) on the basis of our or a third-party’s legitimate interest and you object to such processing. Please provide us with detail as to your reasoning so that we can assess whether there is a compelling overriding interest in us continuing to process such data or we need to process it in relation to legal claims. Also note that you may exercise your right to request that we stop processing the data whilst we make the assessment on an overriding interest; 

Withdrawal of Consent.You can withdraw your consent at any time by changing your marketing preferences in “My Account” or by unsubscribing at the bottom of each email received or by writing emailing us as set out below.

17. MODIFICATIONS AND UPDATES TO THIS PRIVACY POLICY

We may revise this privacy policy from time to time. The most current version of the privacy policy will govern our use of information about you and will be located here: https://www.hntrism.com/privacy-policy. If we make material changes to this privacy policy, we may notify you by email or by posting a notice on the Site. By continuing to access or use the Site after those changes become effective, you agree to be bound by the revised privacy policy.
